Terms of sale
Purpose
These terms of sale ('Terms of Sale') govern the sale of paid services offered on OUI ARE FAMILY® by FERRERO Franck, a French sole trader (auto-entrepreneur) registered under SIRET number 528 172 521 000 31, to members of the site. Any order of a paid service implies full and unreserved acceptance of these Terms of Sale.
Paid services concerned
The paid services offered on the platform are: Boosts, which provide temporary featured placement of a member's profile in search and matching results, and paid registrations for certain Meetups organised via the Meetups module. Payment for these services is processed by our online payment provider, Stripe.
Price
The price of each paid service is displayed in euros, all taxes included, before the member validates the order. The applicable price is the one displayed at the time of the order. OUI ARE FAMILY® reserves the right to change its prices, with no effect on orders already validated.
Payment terms
Payment is made online, by bank card, via the secure Stripe solution, at the time the order is validated. The order is only considered final upon receipt of payment confirmation from Stripe. No banking data is stored by OUI ARE FAMILY®.
Right of withdrawal
In accordance with Article L.221-18 of the French Consumer Code, consumer members are in principle entitled to a 14-day period to exercise their right of withdrawal. However, for digital content or services whose performance begins immediately after the order at the member's express request (immediate activation of a Boost, confirmed registration for an upcoming Meetup), the member is informed that they waive their right of withdrawal once they expressly accept immediate performance of the service and acknowledge the loss of that right once the service has been fully performed.
Cancellation terms
A Boost that has already been activated cannot be cancelled or refunded once its display has started. For a paid registration to a Meetup, the applicable cancellation and refund terms, if any, are specified on the event page before payment is validated. Any cancellation request must be sent to support@plateformweb.com.
Liability
OUI ARE FAMILY® implements reasonable means to ensure the proper functioning of paid services. Its liability cannot be engaged in the event of temporary unavailability of the payment service, malfunction attributable to the Stripe provider, or force majeure. Regarding Meetups, OUI ARE FAMILY® acts as a technical intermediary and cannot be held liable for the running of the event itself.
Disputes and mediation
In the event of a dispute relating to an order, members are invited to first contact support@plateformweb.com in order to seek an amicable solution. Failing agreement, and in accordance with applicable regulations, consumer members may resort free of charge to a consumer mediator. These Terms of Sale are governed by French law; failing an amicable resolution, the competent French courts shall have sole jurisdiction.
